These Terms of Use ("Agreement") govern the use of the Commoware Agency Platform accessed at commoware.com, the processing of the information you share, and your communication consents. By using the platform or submitting a form, you accept the terms below.
1. Parties and Definitions
This Agreement is made between Commoware, which operates the "COMMOWARE Platform" provided at commoware.com, and the natural or legal person who uses the platform, registers, or submits a contact/download form (the "User"). "Agency Platform" means the software service through which travel agencies run their website, reservation, sales and operations on commoware.com.
2. Subject and Coverage
The subject of this Agreement is to set out the terms of use of the COMMOWARE Platform (commoware.com), the processing of the information shared by the User, and the communication consents. By submitting a form or using the service, these terms are accepted electronically.
3. Description of the Service
The COMMOWARE Platform is an Agency Platform that enables digital management of the sale of travel products such as tours, transfers, hotels, flights, villas and visas, website setup, XML/API integrations, payment collection and agency operations.
4. Membership and Usage Terms
The User declares that the information provided is accurate and up to date, and that the platform will be used in compliance with applicable law and good-faith principles. The User is responsible for the confidentiality and security of their account credentials.
5. Commercial Electronic Message Consent (SMS and Email)
By approving this Agreement, the User declares: "I consent to receiving SMS and email notifications from Commoware." Accordingly, the User gives explicit consent to receive informational messages, delivery of requested e-books/documents, announcements, campaigns and marketing messages via SMS and email. This consent can be withdrawn at any time via the opt-out in the messages or by writing to [email protected].
6. Protection of Personal Data
Your full name, email, phone and request details are processed to evaluate your request, deliver the document, provide the service and contact you, in line with applicable data protection law. Data may be shared with our infrastructure, messaging and email providers to the extent necessary to deliver the service; it is not sold to third parties except where legally required.
7. Consent Record (Proof of Consent)
The SMS and email communication consent given by the User is recorded together with the date-time of consent and the page/action where it was obtained, and is retained for the period required by law to serve as proof of consent.
8. Intellectual Property
The software, design, brand, logo and content of the COMMOWARE Platform (commoware.com) belong to Commoware and may not be copied, reproduced or used without permission.
9. Limitation of Liability
Commoware cannot be held liable for disruptions arising from third-party operator, supplier, payment and integration services. The platform is provided "as is" to the extent it is accessible.
10. Changes, Effect and Contact
